These Terms of Service (the "Terms") constitute a legally binding agreement between you and DONGYANG INTERACTIVE ("we," "us," or "our") governing your access to and use of our mini-games (the "Game(s)") offered on the TikTok platform (the "Platform"). Please read these Terms carefully before using our Game(s). By accessing or using the Game(s), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Game(s).
You must be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) to use our Game(s). If you are between the ages of 13 and 18 (or the legal age of majority), you may use the Game(s) only with the consent and supervision of a parent or legal guardian.
You represent and warrant that you have the right, authority and capacity to enter into these Terms and to abide by all the terms and conditions herein.
To use our Game(s), you must log in via your TikTok account. You are responsible for maintaining the confidentiality of your TikTok account credentials and for all activities that occur under your account.
You agree to provide accurate, current and complete information when using the Game(s) and to update such information to keep it accurate, current and complete.
You may not share, sell, transfer or assign your game account or virtual items to any third party without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Game(s) for your personal, non-commercial entertainment purposes only, subject to these Terms.
You may not: (a) copy, modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works of the Game(s); (b) remove any copyright, trademark or other proprietary rights notices from the Game(s); (c) use the Game(s) for any commercial purpose or on behalf of any third party; (d) interfere with or disrupt the operation of the Game(s) or the servers or networks connected to the Game(s); (e) use any automated means, bots, scripts or cheat tools to access or use the Game(s) or gain an unfair advantage.
The Game(s) may offer virtual in-game items, currency or content ("Virtual Items") for purchase with real money.
All purchases are final and non-refundable, except as required by applicable law or expressly stated otherwise. You acknowledge that you do not own any Virtual Items; instead, you are granted a limited license to use them within the Game(s).
We reserve the right to adjust, modify, or remove Virtual Items at our discretion, with or without notice.
You agree not to engage in any of the following prohibited activities while using the Game(s):
Violating any applicable laws, regulations, or third-party rights (including intellectual property rights, privacy rights, etc.).
Harassing, threatening, defaming, abusing, or harming other users or third parties.
Posting, transmitting, or sharing content that is unlawful, obscene, indecent, violent, hateful, discriminatory, or otherwise objectionable.
Cheating, hacking, or exploiting bugs or glitches in the Game(s) to gain an unfair advantage.
Interfering with other users' enjoyment of the Game(s).
Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
All intellectual property rights in the Game(s), including but not limited to copyrights, trademarks, patents, trade secrets, game content, graphics, audio, video, text, and Virtual Items, are owned by us or our licensors.
You may not use, copy, distribute, modify, or create derivative works of any intellectual property contained in the Game(s) without our prior written permission.
We reserve the right to suspend or terminate your access to the Game(s) immediately, without prior notice or liability, if you breach any provision of these Terms.
Upon termination, your right to use the Game(s) will cease immediately, and we may delete your game account and related data in accordance with our Privacy Policy.
You may terminate your use of the Game(s) at any time by ceasing to access or use them and uninstalling them from your device.
THE GAME(S) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE GAME(S) WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE GAME(S), INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATED TO THE GAME(S) SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE USE OF THE GAME(S) IN THE TWELVE MONTHS PRIOR TO THE CLAIM ARISING.
We may revise these Terms from time to time. The revised Terms will be posted on the Game(s) with an updated "Last Updated" date. Your continued use of the Game(s) after the effective date of the revised Terms constitutes acceptance of the changes.
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Game(s) shall be resolved through good-faith negotiations. If unresolved, disputes shall be settled in the competent courts of Singapore, and you consent to the exclusive jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and us regarding the Game(s) and supersede all prior or contemporaneous agreements, understandings, or communications.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
